1. About these terms
These Terms & Conditions govern your use of SmartMark AI, an AI-assisted marking service for exam papers, classwork, coursework and homework. By creating an account or purchasing credit packs, you agree to these terms.
2. Your account
You must be a teacher, school employee or other education professional to use SmartMark AI. You are responsible for keeping your login details secure and for all activity under your account. You must only upload work you are permitted to process (for example, your own pupils' work, in line with your school's data protection policies).
3. Free trial and credit packs
At sign-up you choose one free trial — 25 assessment papers, 50 classwork pages or 15 coursework assessments — which is marked free of charge, with no card required. Once your trial allowance is used, marking is paid for through one-off credit packs; each assessment paper, classwork page or coursework submission marked uses one credit from its own balance. Credits never expire and are non-transferable. Credit packs are one-off purchases — there is no individual subscription and no automatic renewal.
4. Payment
Payments are processed securely through Base44 Payments. Prices are shown in GBP and include VAT where applicable. Credits are added to your balance automatically once payment is approved. If a payment is refunded or reversed, the corresponding credits may be removed.
5. AI marking and your responsibility
SmartMark AI provides AI-generated marks and feedback which you must review before sharing with pupils. The teacher remains professionally responsible for all final marks and reports. Low-confidence scripts are flagged for your review; you may adjust or approve any mark.
6. Pupil data and privacy
Pupil work is stored in private storage, encrypted in transit and at rest, and is never used to train AI models. We process personal data in line with GDPR and our Privacy & Compliance practices. You are responsible for obtaining any consents required at your school before uploading pupil work.
7. Acceptable use
You may not use SmartMark AI to process material you are not authorised to use, attempt to disrupt the service, resell access, or extract data to build a competing product.
8. Service availability
We aim for a reliable service but do not guarantee uninterrupted availability. We may update, suspend or discontinue parts of the service; where reasonably possible, we will give notice of significant changes.
9. Cancellation and deletion
You may delete individual pupils' work at any time from within the app, and you may delete your account entirely from account settings. Deleting your account permanently removes your stored papers, marks and reports.
10. Liability
To the fullest extent permitted by law, SmartMark AI is provided 'as is' and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited under English law.
11. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
